Usage Licence

Summary

​

When you hire Focal Point to complete any service, you are purchasing a non-exclusive usage license for the photos, videos, and all other delivered items for use on one property listing and any other marketing materials related to that specific listing. This usage licence does not allow for any form of re-sale, re-use, sharing or modification of our media and Focal Point retains the ownership of all our media and we reserve the right to distribute or re-sell any of these media products in the future.

Legal Text

​

Focal Point Photography Inc (hereafter called Focal Point) is the sole owner of all photographs, videos, and all other delivered items (hereafter called Media). You are purchasing the right to use our Media for the duration of a single listing (the duration of a single listing is from the time of engagement and provision of the Media until the sale or termination of listing). Focal Point provides for the continued use of our media after the sale or termination of listing only for archival purposes. Any further usage of our media, for subsequent listings of the same or similar properties, or the usage of common building & amenity space media will require a new usage licence to be purchased. Any link, use or reproduction of any Focal Point photograph or video without the written consent from Focal Point is strictly prohibited. Any unauthorized usage of Focal Point media will result in an invoice for the full value of a new booking to capture and edit that media. Focal Point retains the right to all media captured, be it video, photographs, or other, and can use the media for marketing or other non-malicious purposes. Focal Point reserves the right to re-sell the Focal Point photographs and videos for a fee, and without notice being given to the client whom originally ordered the media captured/created.

Payments

​

Invoices will be delivered upon delivery of the requested services and provision of final media. All payments are due within 7 days of receipt of the invoice. We reserve the right to terminate or temporarily remove access to any Focal Point media due to non payment or late payment. Non-negotiable late fees of 2% per month will be added on the first day following the original 7 day period and will be applied again every 30 days thereafter. The amount of late fees will be added to the balance owing and further late fees will be applied to the entire balance, including previously charged late fees.

Location Preparation

​

Focal Point will capture photo's and video of the property as-is upon our arrival. We are unable to move/arrange any items belonging to the property owner and/or tenant. All property staging should be completed and the property should be fully cleaned and arranged prior to the arrival of Focal Point Staff. Cancellation / Rescheduling

​

Short notice cancellations or rescheduling requests can result in a time slot remaining permanently unbooked, as such, any cancellation or rescheduling with under 2 business days notice will be subject to a fee as follows:

​

2 or more business days prior: No Charge

1 Business Day prior: 25% of the full booking amount.

Same Day (Up to 2 hour prior): 50% of the full booking amount.

Under 2 Hour OR already on-site: 100% of the full booking amount.

Example: Service is booked for 1:00pm Thursday

​

Tuesday 7:00pm or earlier: No Charge

During business hours Wednesday: 25% fee

After business hours Wednesday (7:00pm) until 11:00am Thursday: 50% fee

After 11:00am Thursday: 100% Fee

All fees will be added to your account and invoiced immediately, Focal Point may require these fees to be paid prior to any additional services being rendered or booked.

Delay

​

Your appointment time has been specially reserved for you and booked with the amount of time needed to complete capture of the media you have requested, delays in accessing the property may result in a reduction of the amount of rooms and/or features that can be captured during your appointment.

Adverse Weather

​

With the lower mainland receiving approximately 170 days a year of rain, Focal Point has equipped itself to complete its services regardless of most weather types. Photography taken in the rain can be equally as effective as photography captured on a sunny day and as such cancelations and rescheduling due to rain are subject to our typical cancelation policy.

Some forms of weather, such as a deep fog, result in conditions that are not conductive to media capture and as such we will reschedule your appointment at no charge. Focal Point will notify you and discuss options should the weather be adverse enough to cause an issue with your appointment.

Corrections and Re-edits

​

We stand behind out work, if you are unhappy with any aspect of the final product you receive that is within our control please contact us and we will make it right!

Special Requests and Re-shoots

​

If you have any specific requests for your appointment please provide us with as much advanced notice as possible. Focal Point will do its best to accommodate any requests made on the day of your appointment; special request that extend time on site or will require additional post production time above that included in your package may result in additional charges. If Focal Point staff are required to return to the property, after your original appointment, for additional image or video capture, through no fault of our own, there will be an additional charge.
